License agreement for pre-release version of JDK Beta1 for OS/2, AIX, and Windows 3.1 (the "Program").

International Business Machines Corporation "IBM" owns or is licensed under the Program. IBM grants you a non-exclusive, non-transferrable License to use the Program internally solely for the purposes of testing and evaluating the Program in conjunction with the development of your applications and to copy the Program as reasonably required for such purposes. You may not modify the Program, decompile or otherwise reverse engineer the Program. You may not distribute, sublicense, or use the Program externally.

The Program is a pre-release version and may be of lower quality (for example, reliability or performance) than generally available IBM products. The program is not fault-tolerant and is not designed, manufactured or intended for use as on-line control equipment in hazardous environments. IBM does not guarantee that the Program will ever be made generally available, or that any future versions will be compatible with this version. IBM will not provide any support for this pre-release version.

The program is provided "as is" without any warranty express or implied, including the warranty of non-infringement and the implied warranties of merchantibility and fitness for a particular purpose.

IBM will not be liable for any damages suffered by you as a result of using the Program. In no event will IBM be liable for any special, indirect or consequential damages or lost profits even if IBM has been advised of the possibility of their occurrence. IBM will not be liable for any third party claims against you.

By downloading, using or copying the Program, you agree to abide by the intellectual property laws, and all other applicable laws of the US. You obtain no rights to the Program other than those granted to you under this License.

You agree not to export, re-export or otherwise transfer the Program to any person or company which is a resident of any proscribed country listed in the US Export Administration Regulations without proper authorisation by the US Govt.

You agree that any comments, suggestions or other feedback from you relating to the Program may be freely used by IBM for product development, marketing, or any other business purpose, including authorising such use by others.

With effect from 18 July 1996, this License is of indefinite duration. IBM shall have the right to terminate this License immediately by written notice upon your breach of, or non-compliance with, any of its terms. You will be liable for any infringement or damages resulting from your failure to abide by the terms of this License.

This License shall be governed by the laws of the State of New York, USA.
